Mac non-native-fullscreen keeps moving?

For some reason - with macos-non-native-fullscreen=true, it /sometimes/ shows it full screen, and other times it jumps down below the notch.

I can re-fullsize it after it jumps down, but before long it's back to sitting below the notch.

It especially happens when adjusting screen brightness.
